OF THE POSSIBILITY OF SUCH DAMAGE. SUBSCRIBER’S SOLE REMEDY IN CASE
OF DISPUTE IS SUBSCRIPTION FEES PAID.
LEAGUE COMMISSIONERS. FHD reserves the right to act
as Commissioner for any league in which the existing Commissioner is
not responsive or is inactive, is not acting in the best interest of
the league, or is acting in a negligent or abusive manner. In
such circumstances, FHD will attempt to contact the existing commissioner
and resolve the issues. Failing that, FHD will attempt to determine
if there is a consensus among league members for a new Commissioner.
If this also fails, FHD reserves the right to act as the Commissioner.
DEAD TEAM POLICY. A dead team is declared when FHD is
made aware of it by an FHD member. Dead teams have essentially
been abandoned, are not competitive, and may be causing an unfair situation
in the associated league. FHD members understand and agree that
no action is necessary because, due to the unique design of FHD Precision
Leagues, the dead team will essentially constitute a bye week for whomever
that team plays. FHD members further agree that dead teams are
a distinct possibility that cannot be controlled or mitigated by FHD,
and FHD has no control over who may or may not benefit from scheduling
related to a dead team. FHD will not be responsible for any
irregularities that may be related to a dead team.
LAST MINUTE INJURIES AND OTHER "DID NOT PLAY" (DNP) SITUATIONS.
From time to time, players will become injured or otherwise unable to
play at some point prior to or just after game time. Up until
game time for that player, league members will have the opportunity
to "re-deal" a player who for any reason is unable to play. League
members will have up to 4 opportunities to re-deal players in their
lineup. If, after the NFL games have been completed, a player
who was unable to play remains on a FHD league member's roster, that
player will be assigned an Off-By Score equal to the average individual
Off-By Score for that player's league for that week. The League
Average Off-By Score will be published every week. FHD does not
guarantee that all such situations will be identified and bears no responsibility
for any that are not. FHD will not be responsible for any
irregularities that may be related to a last-minute injury or other
situation preventing a player from playing.
IRREGULARITIES. FHD reserves the right to correct irregularities
related to data, systems, or anything else that could provide an unfair
advantage to one or more FHD members in competition with other FHD members.
FHD will act as quickly as possible to correct such situations, but
bears no responsibility regarding timeliness or identification of irregularities.
FHD will not be responsible for any irregularities that may be
related to any such data, system, or other irregularities.
